Plain Packaging Nationalizing IP

The Australian Federal Government’s intention to have mandatory cigarette package plain packaging in place by year 2012’s end is again making the morning news. Now while I really dislike anybody smoking near me and think that it is fair enough to legislate package advertising, and expect the court to support the Government’s right to do it, I nevertheless expect that the Constitutional provision for fair compensation for appropriated property to cost us all dearly.

The Carbon Tax impact on us all may well pale by comparison. Compensating tobacco companies for their loss of intellectual property and branding could well cost us tax payers billions of dollars and that is before any external sovereign interests decide to have a go at us for seizing the property of their countries companies – à lá Cuba & the USA.
